Dare Fusion, Inc. Privacy Policy


www.darefusion.com is a domain name belonging to Dare Fusion, Inc., a Delaware corporation (referred to herein as “Dare” or “us” or “we”). This document explains what information we collect about visitors, users, hosts, guests, and subscribers (together referred to as “Users” or “You”) to our website, mobile applications, and all affiliates, including Dryft.me (“Dryft”) and JamSpot.io (“JamSpot”) (Dryft, JamSpot, Dare, and all of its affiliates, collectively referred to herein as the “Platform”) and how we use this information.


The privacy of those who visit our websites is important to us. We design and operate our technology and services with our Users’ protection and privacy in mind. This Privacy Policy outlines the types of information we gather when Users access Dare’s websites, mobile applications, technology, and services (collectively, the “Services”), as well as the precautions we take and methods we use to safeguard information against unauthorized use.


Data Collection

This Privacy Policy applies to Dare Fusion’s websites, mobile applications, and related services (collectively, the “Services”).


Dare Fusion does not routinely collect personally identifiable information from individuals who merely visit our websites or browse our mobile applications without creating an account. Like many digital services, we use standard technologies such as cookies and similar tools (or their mobile equivalents) to assign visitors a unique, random identifier. These technologies allow us to understand how our Services are used, including which pages or features are accessed, and to collect aggregate statistical information. This information helps us operate, maintain, and improve the Services.


You may disable cookies or similar technologies (or their mobile equivalents) through your web browser or device settings; however, doing so may limit your ability to access certain features or functionality of the Services.


Dare Fusion does not knowingly collect, use, or maintain personal information from any person under the age of 13 (“Children”). The Services are not directed to children under 13, and individuals under 13 may not use the Services. If we learn that personal information from a child under 13 has been collected without appropriate parental consent, we will take reasonable steps to delete such information promptly.


A note to individuals under 18: Please obtain permission from a parent or legal guardian before using the Services or submitting any personal information. Certain features or services may require parental involvement or consent.


For users who create an account or purchase services, Dare Fusion collects limited personal information necessary to provide and operate the Services. This may include information such as a display name or username, email address, account credentials, payment information, and transaction details. We also collect usage information related to account activity, content interactions, and purchase history in order to administer accounts, process transactions, enforce our Terms of Service, and support Dare Fusion’s business operations.


When you use our mobile applications, we may additionally collect limited technical and usage information such as device type, operating system, app version, session activity, and interaction data. This information is used to operate the Services, provide customer support, ensure security, and improve performance. We do not use this information to identify users outside of their account relationship.


Dare Fusion may also retain user-submitted content, feedback, reviews, ratings, comments, or communications in accordance with our Terms of Service, Terms of Use, and applicable law.


Device Permissions and Mobile Data

When you use our mobile applications, we may request access to limited device features necessary to operate the Services. This may include access to local device storage or photo libraries for purposes such as selecting and uploading a profile image. We do not request access to your camera, microphone, or location services for standard video viewing.


All device permissions are user-controlled and are not activated without your consent. You may revoke permissions at any time through your device settings; however, doing so may limit certain features or functionality of the Services.

Use of Information


We may use the information you provide us for purposes such as:


  • Providing you with the Site and service information;
  • Providing you with our content and space listings;
  • Supporting the Site and the services offered on or through the Site;
  • Delivering the services you request and processing transactions and billing;
  • Contacting you for feedback about our services;
  • Notifying you of technical updates or changes in our policy;
  • Providing you customer service support;
  • Sending you push notifications through our third-party provider to alert you to updates, offers, or messages; or
  • For any other purpose for which the information was collected.

Sharing of Information


We do not rent or sell your personal information. We do, however, work with trusted partners who perform vital functions as part of our operations. We may share information with others under any of the following circumstances:

  • To our trusted third-party providers who perform services on our behalf, including credit card processing, cloud hosting, push notification delivery, and email services, but only to the extent such information is necessary to perform such services;
  • When interacting with us on third party social media websites, the information you choose to provide may be displayed publicly;
  • If we are required to do so by law, in connection with litigation, a crime, or to protect personal property, the public, or the Site;
  • In connection with a sale, merger or corporate change; and
  • With your prior consent.

Third-Party Services


Dare Fusion relies on trusted third-party service providers to operate, maintain, and support the Services. These providers perform functions on our behalf such as payment processing, cloud hosting and infrastructure, video storage and delivery, email delivery, analytics, and customer support. We share only the information reasonably necessary for these providers to perform their services and require them to handle such information in accordance with applicable data protection laws.


Third-party service providers process information under their own privacy policies and terms. Dare Fusion does not control and is not responsible for the privacy practices of these third parties. We encourage users to review the privacy policies of any third-party services they interact with in connection with the Services.


Dare Fusion does not permit third-party service providers to use personal information for their own marketing purposes unless you have provided separate consent.


Notifications


We may use the information you provide us to send you emails or in-app push notifications about new offerings or updates. If you do not wish to receive promotional emails, please opt out in any offer email you receive from us. You can disable push notifications through your device settings, however understand you may still receive service-related notices (e.g., security, billing).


Security Practices


When a User enters sensitive information (such as credit card numbers) on our registration or order forms, we encrypt that information using secure socket layer technology (SSL). We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and while maintaining this information. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot and do not guarantee the information’s absolute security.  Dare will not share with or sell or lease sensitive credit card information to third parties, unless required to do so in connection with collection proceedings or otherwise as ordered by a court of competent jurisdiction.


California Privacy Rights


Section 1798.83 of the California Civil Code provides that residents of California can obtain certain information about their personal information that companies have shared with third parties for direct marketing purposes during the preceding calendar year. California residents may have additional rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), including the right to request access to or deletion of certain personal information, subject to applicable exceptions.


How to Unsubscribe


If you would like to opt out of receiving promotional emails from us, please follow the unsubscribe instructions located in each such email or contact us at info@darefusion.com. Please understand that if you opt out of receiving promotional correspondence from us, we may still contact you in connection with your Account, relationship, activities, transactions and communications with us.


Legally Required Disclosure


We reserve the right to disclose your personally identifiable information if we are required to do so by law or if we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process. We also maintain the rights to transfer your information in case of a corporate restructuring (such as a merger or acquisition) as long as the receiving entity adopts this or a stricter privacy policy that applies to your information.


Changes to This Policy


Dare constantly strives to provide the best products and services. Because the Internet is a dynamic and ever changing medium and as new or changed products and services are released and threats and technologies evolve, changes to this policy may be required. Dare reserves the right to amend this Privacy Policy at any time. We expect most such changes to be minor, but there may be cases where changes may be more significant. We urge you to examine this policy for changes when using this site.

Terms of Use


This Privacy Policy is part of and incorporated into the Dare Terms of Use (“TOU”) governing all activity in connection with the Services. (See www.darefusion.com/tou.) By accepting the TOU (whether passively by way of use of the Site or Services or actively by way of affirmatively entering into a User Agreement, Sales Representative Agreement, or as a purchaser or Recipient of a Gift Card), you agree to be bound by the Platform Terms, including but not limited to the arbitration provisions thereof (see dryft.me/terms-of-service#arbitration).
